By accessing or using any services, websites, games, or applications operated by Miramtech ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

These are the general terms for all Miramtech properties. Individual services may have additional terms that apply alongside these general terms.

The Miramtech name, logo, X3JS, and all related product names are trademarks of Miramtech. Use of these trademarks without prior written consent is prohibited.

6. User-Generated Content

Some of our services allow you to create, upload, or share content (such as games, assets, or other materials on the X3JS platform). By submitting content, you:

• Retain ownership of your original content
• Grant Miramtech a non-exclusive, worldwide, royalty-free license to host, display, and distribute your content as part of operating the service
• Confirm that you have the rights to the content you upload
• Agree not to upload content that is illegal, infringing, offensive, or violates the rights of others

Asset Verification: Certain services, such as the X3JS game engine, allow you to upload original assets (3D models, textures, audio, and other media) through our asset management system. To publish games containing your own uploaded assets, you may be required to provide identity verification documents to confirm that you are the rightful owner or authorized licensee of the assets. This verification process helps protect intellectual property rights across our platform and ensures that published content does not infringe on the rights of others.

We reserve the right to remove any content that violates these terms or fails to meet our verification requirements without prior notice.

7. In-App Purchases and Payments

Some of our services may offer in-app purchases, subscriptions, or premium features. All purchases are processed through the respective platform (Google Play, Apple App Store, or our own payment systems). Refund policies are governed by the applicable platform's terms. Prices may change at any time, and we are not obligated to provide refunds except as required by law.

Our services may display advertisements from our own advertising network and third-party providers including Google AdSense and Google AdMob. By using our services, you acknowledge and accept the presence of advertising. You agree not to interfere with, block (on services where this is prohibited), or manipulate ads or ad delivery systems.

• Perform maintenance that may temporarily affect availability

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. 12. Limitation of Liability

To the maximum extent permitted by law, Miramtech shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services, including but not limited to loss of data, revenue, or profits, even if we have been advised of the possibility of such damages.

Our total liability for any claim related to our services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or $100 USD, whichever is greater.

You agree to indemnify and hold harmless Miramtech, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of our services, your violation of these terms, or your infringement of any third-party rights.

14. Termination

We may suspend or terminate your access to any Miramtech service at our sole discretion, with or without cause, and with or without notice. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) will continue to apply.

15. Governing Law

These terms are governed by and construed in accordance with the laws of the Republic of Turkey, without regard to conflict of law principles. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

16. Changes to These Terms

We may update these Terms of Service from time to time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised terms. For material changes, we will make reasonable efforts to notify users through our services.

17. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
